Terms And Conditions

 

PLEASE READ CAREFULLY BEFORE BOOKING YOUR TRIP OR SERVICE WITH PECULIAR TRAVEL LLC

The following  Terms and Conditions (the “Terms”) apply to any trip or service booked with Peculiar Travel LLC and govern contractual relationship between you and Peculiar Travel LLC. Please carefully understand that by booking a trip or service with Peculiar Travel LLC (hereinafter, “Company”), you accept the terms and conditions and bound set forth herein. 

By booking any Trip or Service with Peculiar Travel LLC, or by traveling on a Peculiar Travel experience you acknowledge that you: i) have read and understand these Terms, and ii) indicate your express acceptance of and agree to be bound by these Terms. If you have confirmed a booking on any trip or service with more than one Client named and booked on such booking, you shall be deemed to have accepted these Terms on behalf of all Clients named in the booking (including minors and those under a disability) and traveling on or otherwise participating in any Products (hereinafter “you”, the “Client(s)”), and by such travel or participation all passengers indicate their assent to these Terms. The Client who confirmed the booking is deemed to be the designated contact person for all other Clients named in such booking. These Terms constitute the entire agreement between the Client and Peculiar Travel LLC with respect to the subject matter thereof and supersedes all prior agreements, representations and understandings of the parties, written or oral.

The Contractual Booking Agreement

A booking is confirmed, and these Terms shall apply when Peculiar Travel LLC, have received the applicable deposit from the Client and the Client has received written confirmation from Peculiar Travel LLC regarding the booking. The Client confirming the booking must be no less than 21 years of age and agrees to provide full, complete and accurate information as requested by Peculiar Travel LLC to confirm such booking. Any Client confirming a booking on any Products with more than one Client named and booked on such booking represents and warrants to Peculiar Travel LLC that: i) they have all requisite consents and authority to make such booking on behalf of all other Clients named on the booking, and have communicated all necessary information to the other Clients in order for them to give free and fully informed authorization to do so; ii) the information that they are providing regarding all Clients is complete and accurate, and they have obtained all necessary consents and permissions to share such information with Peculiar Travel LLC for the purposes of completing the booking; and iii) they will inform all other named Clients on the relevant booking of the applicability of these Terms to the booking and the Clients’ relationship with Peculiar Travel LLC.

At any time before a booking is confirmed, Peculiar Travel LLC reserves the right to increase or decrease brochure prices of any Trip, Product or Service. Peculiar Travel LLC  reserves the right to decline any booking, in their sole discretion.

Pricing Policy 

Payments

Peculiar Travel accepts Mastercard/Visa/American Express via PayPal (plus 3% processing fee)  and Venmo only. Peculiar Travel does not accept checks or cash nor transactions via Cashapp. 

The total payment is due prior to the start date of the planned trip or service offered. Each group trip is priced per person. If Peculiar Travel LLC does not receive your total payment on or before the payment due date, the company may cancel your reservation and you will forfeit your deposit and the amount paid to date. Your deposit is non-refundable and non-transferable, at the time of booking to secure your space.  Failure to make a payment within five (5) days of the agreed upon date is a breach of contract and will result in a $25 late fee added to balance. 

Trip Cancellation

In the event that a Client cancels within 60 days of the date of arrival, Peculiar Travel LLC will retain 100% of the paid funds. It is recommended that Clients purchase trip cancellation coverage. Trip cancellation insurance is the only means of receiving reimbursement for flights and other non-refundable expenses should you cancel your trip for any reason, whether voluntarily or as a result of Peculiar Travel LLC’s actions. 


Refund Policy

Deposits are non-refundable and all payments made towards the balance of your trip are non-refundable seven (7) days after the payment is made, including late fees, full payments and installment payments. In the event that Peculiar Travel LLC cancels a trip, the Client will be notified via email with refund instructions. 

Passport and Travel Insurance:

The Client is responsible for obtaining his or her own valid passport. Peculiar Travel LLC is not responsible if the Client is denied entry or exit to/from any country due to a lack of a valid passport. 

The Client is responsible for purchasing travel insurance coverage. We recommend that you purchase travel insurance at the point of booking your spot on one of our trips to cover you for the duration of the trip and in the event that you are unable to attend the trip. The Client’s travel insurance policy should include a minimum of $100,000 of coverage. 

Purchase of Domestic & International Airfare

For each Peculiar Travel LLC group trip and service offered, the Client is responsible for purchasing their airline ticket to the origination of the scheduled trip. Each trip registrant is responsible to provide a digital copy of their travel itinerary to Peculiar Travel LLC one (1) week prior to date of arrival. 

Waiver of Liability & Indemnity

You voluntarily assume full responsibility for and hereby release Peculiar Travel LLC and covenant not to sue the company for any and all claims, personal injuries, medical expenses and/or losses.  You further hereby agree to indemnify and hold harmless the company parties from any and all liabilities (including without limitation court costs and attorney’s fees) that one or more of the company parties may incur as a result of your participation in the getaway, whether caused by the negligence of any company party or otherwise (but excluding any gross negligence or willful misconduct of a company party), to the fullest extent allowed by applicable law.

Force Majeure

If Peculiar Travel LLC (the “Company”) is prevented (directly or indirectly) from performing any of its obligations under this agreement by reason of any Act of God, strike, trade dispute, fire, inclement weather, breakdown, interruption of transportation networks/means, government or political action, acts of war or terrorism, acts or omissions of a third party, or for any other cause whatsoever outside of Company’s reasonable control, company will be under no liability whatsoever to you and may, at company’s sole discretion, by written notice to you, either cancel the getaway or take any other reasonable action. Under such circumstances you will not be eligible for a refund of any amounts paid to the Company for the getaway, and in no event will the Company be responsible for any other amount, including preparation costs, airfare, travel documents, or any other Losses or claimed damages.

Photography and Marketing 

The Client agrees that while participating in any getaway or trip, product images, photos or videos may be taken by other Clients and/or Peculiar Travel LLC representatives that may contain or feature the Client in part or in whole. The Client acknowledges that they consent to any such pictures being taken and agree that Client hereby grants a perpetual, royalty-free, worldwide, irrevocable license to Peculiar Travel LLC, its affiliates and assigns, to reproduce for any purpose whatsoever (including marketing and promotions), in any medium whatsoever, whether currently known or hereinafter devised, without any further obligation to the Client or compensation payable to such Client.
